By submitting this application, you are allowing Ducks Unlimited (“DU”) to evaluate the property described in this application for potential enrollment in the Ducks Unlimited Reforestation Program (the “Program”). Submission of this form does not guarantee selection for the Program, nor does it obligate you, the landowner, DU, or any of its partners, affiliates, or employees to anything whatsoever.
If DU determines that your land may be suitable for enrollment in the Program, a staff member will contact you to discuss your application, and possibly schedule a site visit. Unless otherwise specified, DU will evaluate all applications on a rolling basis. The selection process will be competitive, and not all applications will be chosen. DU will make selection decisions in its sole and absolute discretion, and will promptly notify you of its decision. If your application is selected, you will be offered the opportunity to enroll your property into the Program by signing a binding project development agreement (the “Obligating Document”). The Obligating Document will allow DU to implement a reforestation project on your property, and will provide DU the exclusive right to develop, market, and sell the carbon and related ecosystem service benefits resulting from the reforestation project. Enrollment in the Program is an act of both land restoration and protection that will affect how your land may be used in the future. Your decision to enroll in the Program is completely voluntary, and you may change your mind and withdraw your application at any time until the Obligating Document is signed. After you sign the Obligating Document, it will govern your rights to withdraw from the Program.
Once restored, the property will be protected by a permanent conservation easement (the “Easement”). The Easement ensures that the trees, carbon project, and conservation values of the restored property are protected, while still allowing for compatible uses. The terms of the Easement will be provided to you for review prior to signing the Obligating Document. The Easement will be held by DU, its supporting organization, Wetlands America Trust, Inc. (“WAT”), or another affiliated designee as agreed between you and DU. Once signed, the Easement will be recorded in the land records, and the restrictions will become binding on you and any future owners of the property. Landowner payments will begin once the Easement is recorded.
Neither DU nor WAT provides legal or tax advice. You should consult with your advisors on estate planning, real estate and tax matters and have an attorney assist you in the review of all documents throughout the process.
